MAP Statement on Boulder County District Court Ruling
Washington, D.C. – Phil Goldberg, Special Counsel for the Manufacturers’ Accountability Project, issued the following statement in response the Boulder District Court’s ruling on Friday regarding the motions to dismiss the county’s climate lawsuit.
“The cracks in this litigation campaign keep piling up. In New York City’s lawsuit, the courts detailed the major shortcomings with alleging any company or companies caused specific impacts from climate change. In Delaware, a judge ruled the state could not attempt to regulate conduct or emissions in other states or countries. And now, the judge in Boulder’s case said the allegations do not meet the elements of a viable consumer protection act claim.
The differences among these rulings, particularly when including the Hawaii Supreme Court’s decision, underscore why the Supreme Court should hear the Honolulu appeal and establish a uniform rule of federal law that can be applied wherever these cases are brought.”
